Project: Nottingham Spire Hospital

Client: E.On Control Solutions Ltd

 

RCC Ltd were approached by E.On Control Solutions Ltd to provide Commercial Support Services for a BMS Installation & Commissioning Project at Nottingham Spire Hospital. The Contract Value started at over £500,000 and the original programme was for 36 weeks. RCC Ltd reviewed and amended the Sub-Contract Order Terms and Conditions to reduce risk of “acceptance by action” and remove clauses giving our client risk/reducing ability to claim additional monies.

RCC Ltd carried out the commercial aspects for this project providing formal responses to the Main Contractor to allow the Project Manager to concentrate on completing the project in a timely manner and successfully resolved a dispute relating to the pricing and valuation of variations as based on contract rates.

Following a review of the relevant project information a Delay Notice was issued to the Main Contractor. The letter detailed dates where our Client was unable to work to the Sub-Contract Programme and the reasons/parties that were causing the delay. This process allowed the client to apply for an Extension of Time and reduce the exposure of the Main Contractor levying damages when the completion date of the Works was extended by 18 weeks whilst allowing the client to recover costs for prolongation.

Project: NEC3 Training Workshop

Client: ATS Controls Ltd

 

RCC Ltd were approached by ATS Controls Ltd to provide Commercial Support for a BMS project based in the Falklands Islands. The Main Contractor had selected an NEC3 Engineering and Construction Contract (NEC3 ECC) as the Main Contract and RCC Ltd’s client was requested to operate under a NEC3 ECC Subcontract with Main Contract step-down of obligations. RCC Ltd completed a review of the Contract during the negotiation stage and amended to protect the clients’ interests.

ATS requested that RCC Ltd complete some initial training for the project team. RCC Ltd’s experience with NEC3 ECC allowed them to offer a Training Workshop tailored for the client’s project using the specific contractual obligations. The workshop had two stages; stage one was an introduction to the NEC3 ECC and review the client’s contractual obligations ensuring to fulfil the Contract requirements including completing the Subcontract Programme, Activity Schedule and Quantified Schedules of Rates in the period as allowed in the Contract.

Stage two was prior to the first Application for Payment and detailed the processes in the NEC3 ECC for payment, change management, delay notification and included a review of the of the NEC ECC to allow for a question and answer session. RCC Ltd the provided support throughout the project assisting with pricing of Compensation Events, updating the Subcontract Programme and offering advice for the developing project.
